General Terms and Conditions of Contract

These terms and conditions govern the engagement of services offered by Pedro Martínez Sánchez through the website www.artenocturno.com, including online courses, software (Art Panel Pro plugin), in-person workshops, and photography trips organised by the travel agency Artra Tours (C.I.MU.509.m), owned by the same holder.

The purchase of any product or service implies the customer's full acceptance of these terms and conditions.


1. Purchase or booking process

The purchase or booking request is made via the official website, email, or by contacting the organisation directly. For it to be effective, the customer must:

  • Accept the general terms and conditions of contract.
  • Provide the required personal data.
  • Make the payment accordingly within the established deadlines.

The definitive confirmation will be communicated by email once the initial or full payment has been received, depending on the product or service.


2. Online Courses and Art Panel Pro Software

2.1. Access and Withdrawal The purchase of digital courses and software involves immediate or within-hours access to content or product download. In accordance with Article 103.m of RDL 1/2007, there is no legal right of withdrawal once access or download has begun. However, Arte Nocturno offers a voluntary satisfaction policy. apply exclusively to online courses, whose details and deadlines are found in the section Cancellation and Withdrawal Conditions. The Art Panel Pro software is excluded from this voluntary guarantee., so its sale is final and does not permit returns once access or a licence has been granted.

2.2. Software Licence Agreement (EULA) The software Art Panel Pro It is not sold, but licensed. Its use is strictly subject to an End-User Licence Agreement (EULA) and specific privacy conditions (linked to licence validation and security). By purchasing, downloading or installing Art Panel Pro, the customer declares to know and accept these specific legal terms, which include usage restrictions (1 active device), protection measures and the plugin's privacy policy. 2.3. Compatibility, Requirements and Support (Art Panel Pro) Es responsabilidad del cliente comprobar antes de la compra que cumple los requisitos técnicos publicados en la ficha del producto. En particular, Art Panel Pro requiere Adobe Photoshop (Desktop) oficial, instalado y activado, v24.7.0 o superior (Windows o macOS).

Se recomienda utilizar siempre la última versión estable de Photoshop publicada por Adobe (no versiones Beta/Prerelease) y cumplir los requisitos oficiales de Adobe para dicha versión.

Updates (release policy) Las actualizaciones, correcciones y parches del plugin se publicarán, salvo indicación expresa, únicamente dentro de la misma versión mayor: Art Panel Pro v3.x. Las versiones mayores posteriores (por ejemplo, v4.x) podrán tener condiciones distintas.

Soporte y exclusiones Operation is not guaranteed and no support will be provided for older versions, incomplete or modified installations, installations managed by third parties, or in environments that prevent activation/validation (firewall, proxy, restrictive corporate network, etc.).

En caso de incidencia técnica en un entorno soportado, se ofrecerá soporte vía email y WhatsApp. Dicho soporte se prestará exclusivamente vinculando la consulta al número de teléfono facilitado por el cliente en el formulario de pago (checkout) como identificador obligatorio de registro y asistencia. La falta de veracidad en los datos de contacto o el uso de numeración no vinculada a la región de compra podrá ser motivo de denegación de la asistencia técnica. La falta de cumplimiento de los requisitos publicados o la incompatibilidad del equipo/entorno del cliente no será motivo de reclamación por funcionamiento fuera de soporte, sin perjuicio de los derechos irrenunciables del consumidor por falta de conformidad cuando resulten aplicables.


3. In-person workshops and trips

The in-person workshops and trips published on this website are organised and contracted by the agency Artra Tours (C.I.MU.509.m), owned by Pedro Martínez Sánchez.

Arte Nocturno acts as a promotional and photographic support brand. The technical contracting of workshops and trips corresponds to Artra Tours.

Spaces are limited and allocated on a first-come, first-served basis. In the event of cancellation by the client, the relevant withdrawal conditions will apply.

The client may transfer their place to another person who meets the workshop or trip requirements, provided that they notify us at least 7 calendar days in advance. Any expenses arising from the change will be borne by the new participant.

➤ 4. Prices and payment methods

Prices are expressed in euros and include applicable taxes, unless otherwise stated.

Payments will be made via the methods enabled on the website and/or via the account number provided by Pedro Martínez Sánchez. Access to the products or the reservation will be confirmed upon receipt of payment.

Unless otherwise indicated in the specific conditions of the event or trip, the following will apply:

  • A 30%% initial payment of the total amount to confirm the reservation.
  • The remaining 70% must be paid 30 days before the start of the event.
  • For reservations made less than 30 days in advance, full payment will be required at the time of confirmation.

5. Right of withdrawal and cancellation policy

For online courses, there is no right of withdrawal once the content has been accessed or the course has begun, in accordance with Article 103(m) of Royal Legislative Decree 1/2007.

In the case of downloadable digital products, such as the Art Panel Pro plugin, the customer receives the download link immediately or within a few hours after completing the payment. By confirming the purchase, the customer expressly consents to immediate or within a few hours delivery and acknowledges that, consequently, they forfeit their right of withdrawal from the moment access is granted.

However, Arte Nocturno voluntarily offers an additional satisfaction policy. Therefore, the possibility of requesting:

  • 100% refund% of the amount paid for online courses if requested within three days of the purchase date.

  • Partial refund of 30% of the amount in the case of the Art Panel Pro plugin, requested within the same timeframe.

For in-person workshops, there is no right of withdrawal. If the participant cancels, penalties will apply based on the notice period:

  • More than 60 days before the start: refund of the amount less 30% for administration and booking fees.

  • Between 60 and 31 days before the start: 50%%refund.

  • 30 days or less before the start: no refund.

It is possible to transfer your place to another person at least 7 days in advance, provided they meet the workshop's requirements.

6. Responsibility

In-person events (workshops and trips) booked through this website are organised by the agency Artra Tours (C.I.MU.509.m), also owned by Pedro Martínez Sánchez, who assumes responsibility as the organising agency in accordance with Royal Legislative Decree 1/2007 and other current regulations.


6. Modification of terms

Arte Nocturno reserves the right to modify these conditions at any time. The current conditions will be those published at the time of contracting.
